The U.S. Environmental Protection Agency (EPA) has proposed revisions to its per- and polyfluoroalkyl substances (PFAS) reporting requirements under the Toxic Substances Control Act (TSCA). The changes aim to make PFAS reporting more practical and less burdensome for manufacturers and importers while preserving EPA’s access to essential data on PFAS use and safety.
The proposal follows criticism of the 2023 rule for its high compliance costs—nearly $1 billion—and complex reporting demands. Under the new plan, EPA would exempt reporting on PFAS found in mixtures or products at concentrations of 0.1% or lower, imported articles, certain byproducts, impurities, research and development chemicals, and non-isolated intermediates. The proposal also includes technical clarifications and adjusts the reporting period.
Public comments will be accepted for 45 days after publication at www.regulations.gov under docket #EPA-HQ-OPPT-2020-0549.
