Notification of Senate Bill 362 – Regulation of Water and Wastewater Systems

On March 16, 2018, Governor Holcomb signed Senate Bill 362: Regulation of Water and Wastewater Systems into state law, which is now referred to as Senate Enrolled Act (SEA) 362.  This effort by the Indiana General Assembly represents the State’s commitment to ensuring the long-term viability of our water and wastewater utilities by requiring Asset Management Plans, a Life Cycle Cost Analysis, and a Cybersecurity program for those utilities that are seeking project financing through the Indiana Finance Authority (IFA) State Revolving Loan Fund (SRF) Program. SEA 362 will also require the same for new and expanded wastewater and water treatment plants that will be permitted through IDEM, regardless of the project funding mechanism. Regardless of whether you are currently seeking IFA SRF financing, or have plans to expand the capacity of your wastewater or water treatment facilities, Asset Management, Life Cycle Cost analyses and Cybersecurity should be considered as critical components to protecting your utility.  SEA 362 becomes effective on July 1, 2018.
